Notable Nonprofit Posts, Articles, & Other Resources:

Commentary: To Build A Nation For All, We Need A Founders’ Leadership Stance (Michael McAfee & Ashleigh Gardere, Nonprofit Times)

Here’s what you missed at Turning Point’s chaotic convention (Jonathan J. Cooper and Sejal Govindarao, AP) [Ed. Amidst all of the juicy news of internal conflicts, it should not be lost that AmericaFest appears to be a joint event between Turning Point USA, the 501(c)(3) org, and Turning Point Action, the 501(c)(4) org, at which Turning Point USA CEO Erika Kirk pledged Turning Point’s support for Vance in the next presidential election. If the IRS starts to revoke 501(c)(3) status from progressive orgs for prohibited electioneering violations, this very high-profile event may be difficult to defend (at least from a fairness and justice perspective).]

Nonprofit Killer Bill Re-Introduced in the House and Senate (Charity & Security Network)

Developments in Nonprofit and Association Law 2024–2025 (Jerald A. Jacobs, Dawn Crowell Murphy, Lori Panosyan, Julia E. Judish, Alvin Dunn, Pillsbury Law) [Ed. The article is “a review of notable cases and regulatory developments for associations and other nonprofit organizations at the federal and state levels during the last year …” ending sometime before the date of the article – December 8, 2025.]

EU warns of possible action after the US bars 5 Europeans accused of censorship (Lorne Cook, AP) [Ed. Further evidence of the federal administration’s attack on nonprofits whose views do not fall in line – “The five Europeans were characterized by U.S. Secretary of State Marco Rubio as “radical” activists and “weaponized” nongovernmental organizations. They include the former EU commissioner responsible for supervising social media rules, Thierry Breton.”)

The Fearless Decision and the Future of Race-Conscious Charities (Chenglin Liu, Cleveland State Law Review) [Ed. While I consider the warning in the concluding sentence to lack critical nuance (“… race-conscious charities will have to modify their practices to become more “inclusive,” or else face legal challenges from conservatives”), there are important references and points worth reviewing.]

Navigating Conflict in Movement Spaces (Dean Spade, NPQ)

The Conservative Movement’s Intellectual Collapse (Jonathan Chait, Atlantic) [Ed. The article pays particular attention to the Heritage Foundation.]

Flipcause files bankruptcy, owing $29 million to nonprofits across country (Rasheed Shabazz, Oakland Voices)

2026 Annual Forecast for the Future (various authors, Nonprofit Times, pp. 9-23)

Significant Events:

  • “Nearly 250 years after American colonists threw off their king, this is arguably the closest the country has come during a time of general peace to the centralized authority of a monarch. Mr. Trump takes it upon himself to reinterpret a constitutional amendment and to eviscerate agencies and departments created by Congress. He dictates to private institutions how to run their affairs. He sends troops into American streets and wages an unauthorized war against nonmilitary boats in the Caribbean. He openly uses law enforcement for what his own chief of staff calls “score settling” against his enemies, he dispenses pardons to favored allies and he equates criticism to sedition punishable by death.” NY Times
  • “Elon Musk’s Department of Government Efficiency said it made more than 29,000 cuts to the federal government — slashing billion-dollar contracts, canceling thousands of grants and pushing out civil servants. … But the group did not do what Mr. Musk said it would: reduce federal spending by $1 trillion before October. On DOGE’s watch, federal spending did not go down at all. It went up.” NY Times
  • “The U.S. Supreme Court ruled against President Trump on Tuesday, refusing to reinstate, for now, Trump’s ability to send National Guard troops into Illinois over the objections of its governor. … “At this preliminary stage, the Government has failed to identify a source of authority that would allow the military to execute the laws in Illinois,” the majority wrote in its brief opinion.” NPR
